Company and registration

vieirahome.com is owned and operated solely by JMax B.V., a Dutch private limited company. The details below identify the legal entity behind this website and serve as the official operator disclosure for the storefront.

Registered in the Dutch Commercial Register (Handelsregister) kept by the Kamer van Koophandel.

JMax B.V. is the only legal entity responsible for vieirahome.com and for every commercial transaction made through it. Vieira Home is a trading name of JMax B.V. Formal correspondence can go to the registered office address or the email address above.

Cross-border trading disclosure

Vieira Home is a Netherlands-established retailer selling home goods – lighting, home accessories, kitchen items and gardening products – to customers in the United States. Your contract of sale is with JMax B.V. in the Netherlands, and goods travel internationally to your US delivery address with all import duties paid by us. Shipping, duties and delivery are set out in full in our Shipping Policy.

Although the company sits in the Netherlands, our customer service team keeps United States hours, in Eastern Time. The full schedule is in section 08 and at the foot of this page.

Section 02

Hosting and technical information

vieirahome.com is built and hosted on the Shopify e-commerce platform. The disclosures below identify the third parties that provide the infrastructure, payment processing and security behind this website.

E-commerce platform and hosting

The store is hosted and powered by Shopify International Limited, Victoria Buildings, 2nd Floor, 1–2 Haddington Road, Dublin 4, D04 XN32, Ireland – the Shopify contracting entity for merchants established in Europe – part of the Shopify group headquartered at Shopify Inc., 151 O'Connor Street, Ground Floor, Ottawa, Ontario, K2P 2L8, Canada. Shopify supplies the technology infrastructure, server hosting through its global content delivery network, and the storefront functionality this shop runs on, which keeps page loads fast for customers in the United States.

Payment infrastructure

Payments are handled through Shopify Payments and Stripe. Transactions are encrypted and processed to PCI-DSS standards, and we do not hold full payment card numbers on our own systems. Because our merchant entity sits in the Netherlands, your card issuer may treat the transaction as international and add a foreign transaction fee – that fee comes from your bank, not from us.

SSL and security

The site is secured with an SSL/TLS certificate issued by Let's Encrypt through Shopify's infrastructure, so everything passing between your browser and this site is encrypted in transit. DNS is managed through Shopify's infrastructure.

Shopify platform disclosure

As a Shopify merchant we operate under Shopify's Terms of Service and Acceptable Use Policy alongside the applicable Dutch, EU and US commerce rules; Shopify's own legal terms are published at shopify.com/legal. Shopify is not the seller of record: JMax B.V. is the seller and carries sole responsibility for products, prices, orders, returns and customer service.

Storefront availability

The storefront itself accepts orders 24 hours a day, every day of the year. Our customer service team is a separate matter: it is available during the support hours set out in section 08, and messages that arrive outside those hours are answered on the next business day.

Shopify acts as a data processor for the customer data collected through vieirahome.com. Its role and its data handling obligations are described in our Privacy Policy.

Section 03

Copyright and intellectual property

Everything published on vieirahome.com – text, product descriptions, photographs, graphics, logos, icons, design elements, layout, software and code among it – belongs to JMax B.V. or its licensors and is protected by Dutch, EU, US and international copyright law.

Third-party intellectual property

Products sold here may carry third-party intellectual property rights, including patents, design rights or trademarks held by manufacturers or suppliers. Listing such a product does not grant you any rights in that third-party property. We source and sell in line with the applicable IP licensing, product safety and import requirements in both the Netherlands and the United States.

Content you submit

If you send us a product review, photograph or other content, you grant JMax B.V. a non-exclusive, royalty-free, worldwide, perpetual licence to display, reproduce and distribute it in connection with the Vieira Home brand and this website. You confirm that you own the content or have the right to grant that licence, and that it infringes nobody else's rights. Under Dutch law moral rights in a work cannot be fully waived, and nothing in this licence asks you to do so.

Trademarks

The Vieira Home name, wordmark, logo and associated brand elements are trademarks and trade dress of JMax B.V. They may not be used in connection with any product, service or communication without our prior written authorisation.

Third-party trademarks, product names, brand names and logos that appear on this site – including those of payment providers such as Visa, Mastercard, American Express, PayPal, Apple Pay and Google Pay, of carriers, and of certification bodies – belong to their respective owners. Their appearance here implies no affiliation with, sponsorship by or endorsement of Vieira Home or JMax B.V. We use them for identification only, consistent with the referential and nominative fair use principles recognised under EU and US trademark law respectively.

Website disclaimer

The content on vieirahome.com is published for general information and commercial purposes. We take reasonable care to keep it accurate and complete, but we give no warranty or representation of any kind, express or implied, as to its accuracy, reliability or fitness for a particular purpose, except where the law requires otherwise.

Website availability

We do not warrant that this site will always be available, uninterrupted or error-free. Access may be suspended or withdrawn at any time without notice for maintenance, security updates, technical problems or other operational reasons. We are not liable for loss arising from your being unable to reach the site at a given moment, subject to mandatory consumer rights that cannot be excluded.

Product information and pricing

Descriptions, images, specifications and prices are given for guidance and can change without notice. We work to keep listings accurate, but errors do happen. Where a price is clearly wrong we reserve the right to cancel orders placed at that price, subject to our consumer protection obligations.

Images are representative: actual colours, textures and finishes vary between individual items and look different on differently calibrated screens. Where goods are made from natural materials such as wood, rattan, stone, ceramic or linen, variation in grain, tone and texture between units is inherent to the material and is not a defect. Stated dimensions are approximate and subject to normal manufacturing tolerances. We are not liable for minor differences between a product image and the goods received, provided the product substantially matches its description.

Site performance and errors

We do not warrant that this site is free of bugs, viruses, malware or other harmful components. We take reasonable technical precautions to keep it secure, and we recommend you keep your own antivirus and browser security up to date. We are not liable for damage to your device or data arising from your use of the site.

We are not responsible for the content, accuracy, security, privacy practices or availability of any of them, and a link is not an endorsement or a sign of affiliation. Please read the terms and privacy policy of any external site before handing over personal information or buying anything.

Section 06

Limitation of liability

To the fullest extent the law allows, JMax B.V. and its directors, employees, agents and licensors are not liable for indirect, incidental, special, consequential, punitive or exemplary damages arising out of or connected with your use of vieirahome.com, its content, or any product bought through it.

This limitation covers, among other things

• Errors, inaccuracies or omissions in content published on the site;
• Personal injury or property damage arising from your access to or use of the site, except where liability arises under mandatory product liability law;
• Unauthorised access to or alteration of your data or transmissions;
• Interruption, suspension or discontinuation of the site or any service offered through it;
• Loss of profits, business interruption, loss of data, or any other commercial or economic loss;
• Bugs, viruses, trojan horses or other harmful components transmitted through the site by third parties;
• The content or conduct of any third party on or linked from the site.

DMCA and copyright takedown

We respect intellectual property rights and act quickly on claims of copyright infringement. Because vieirahome.com runs on US-connected infrastructure and serves customers in the United States, we operate a notice-and-takedown procedure modelled on the US Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, alongside our obligations under Dutch and EU law. If you believe content on this site infringes your copyright, send us a written notice using the procedure below.

Your takedown notice must contain all of the following

Notices can be sent at any time. They are reviewed during our support hours, and the date a notice reaches us is the date we work from, not the date we reply. On receiving a valid and complete notice we act expeditiously to remove or disable access to the material concerned, and we notify the user responsible where the law requires it.

Counter-notifications — 17 U.S.C. § 512(g)

If your content was removed following a takedown notice and you believe that was a mistake or a misidentification, you can send a counter-notification to info@vieirahome.com. A valid counter-notification includes: identification of the removed material and where it appeared before removal; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; your name, address and telephone number; and a statement consenting to the jurisdiction of the federal district court for your district if you are in the United States, or of the competent Dutch court if you are elsewhere, together with your agreement to accept service of process.

Knowingly submitting a false or misleading notice or counter-notification can expose you to civil and criminal liability.

Section 08

Governing law and jurisdiction

This Legal Notice, and any dispute or claim arising out of or connected with it, with your use of vieirahome.com, or with any transaction made through it, is governed by and construed in accordance with the law of the Netherlands, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and without regard to conflict of law rules.

None of this limits any statutory right you hold as a consumer under US federal or state law, or deprives you of the protection of mandatory consumer provisions where you live. Where a term of this notice conflicts with such a provision, that provision prevails, and you may be entitled to bring proceedings before the courts of your own state.

Before starting any formal dispute process, please write to info@vieirahome.com or use our contact form. Almost everything – order problems, returns, warranty claims, billing questions – is resolved quickly by our customer service team without formal proceedings.

You can email us or write to us at any time. Our customer service team reads and answers messages during the hours below, in Eastern Time (ET).

FTC compliance and disclosure

We comply with the applicable Federal Trade Commission rules in our US-facing marketing. Material connections between us and third-party endorsers, influencers or affiliates are disclosed as required by 16 C.F.R. Part 255, the guides on endorsements and testimonials. Paid reviews, sponsored posts and affiliate arrangements are clearly labelled. Questions about how we handle disclosure can go to info@vieirahome.com.

Escalation

If you want to take a dispute beyond our customer service team, you can refer it to the US Federal Trade Commission or to the consumer protection office of your state attorney general, either of which may have jurisdiction. We sell to the United States only and do not take part in any EU alternative dispute resolution or online dispute resolution scheme.

Section 09

Accessibility

JMax B.V. wants vieirahome.com to work for everyone, whatever technology or ability they bring to it. We aim to meet the Web Content Accessibility Guidelines (WCAG) 2.1 at Level AA where that is feasible, and we keep improving the site as we go.

The US picture — ADA Title III

How far the Americans with Disabilities Act Title III applies to commercial websites is still developing in US law, and the US Supreme Court has not settled it. We work toward WCAG 2.1 AA conformance voluntarily, as good practice and because we would rather not shut anyone out. Our aim is to remove the barriers that would stop a customer with a disability from browsing this site or completing a purchase. If you hit one, tell us and we will make reasonable efforts to accommodate you.

The European picture

As a Netherlands-established business we also take account of the European Accessibility Act and the EN 301 549 standard when we design and develop the storefront. WCAG 2.1 Level AA is the shared technical benchmark underneath both the European and the US frameworks, which is why it is the standard we work toward.
